POSSIBLE SUNSHINE ACT QUESTION — QUORUM COMMUNICATION VIA PERSONAL EMAIL

❓ OPEN QUESTION Identified Jul 9, 2026

▸ Confidence Level

This is an open question, not a claim. Two required legal elements are unconfirmed from the document alone. Nothing below should be read as asserting a violation occurred.

▸ What the Record Shows

The same December 8, 2023 email (see companion finding: Personal Email Use in Board Correspondence) was sent by then-Board member Brian Fox to six other named individuals — Lisa Yelovich, Lisa Bowman, Brian Norris, Matthew Hurley, Jere Zimmerman, and Charlie Koennecker — all via personal (non-@octorara.org) addresses. Seven individuals total, including the sender. Director Anthony Falgiatore, a sitting Board member at the time who is separately documented (per AP 2026-1329’s factual background) as having formally objected on the record to related litigation expenditures, is not among the recipients.

▸ The Relevant Legal Question

The Sunshine Act, 65 Pa.C.S. §§ 701–716, requires that deliberation of agency business by a quorum occur at a public meeting. Two elements must both be true for this to raise a genuine Sunshine Act question — and neither is confirmed by this document alone:
ELEMENT 1

Whether the named recipients, at the time, constituted a quorum of the Board as then composed.

STATUS: UNCONFIRMED
ELEMENT 2

Whether the email’s content — gathering materials “before showing examples to Tony” — constitutes deliberation toward a decision, or falls short of that as mere information assembly.

STATUS: UNCONFIRMED

▸ Not Asserted

That a Sunshine Act violation occurred. That Director Falgiatore’s absence from the recipient list was deliberate or connected to his prior objection. Any characterization of intent on the part of any individual named in the underlying record.

▸ What Would Resolve the Open Questions

Board roster and quorum threshold as of December 2023 (public record, likely already available or easily obtained). Any similar contemporaneous communications that might show a pattern versus a one-off. Additional context on whether “Tony” and the surrounding correspondence indicate the email was preparatory to an actual Board decision or action, versus simple information-gathering.

▸ Update Log

No updates yet. Entries will be appended here as dated snippets as this finding develops — e.g., confirmation of the December 2023 Board roster and quorum threshold. When this finding resolves (in either direction), this page will be redesigned into a full Achievement, and this Update Log will be replaced by the resolution record.
