PERSONAL EMAIL USE IN BOARD CORRESPONDENCE CONCERNING THE LITIGATION

⏳ AWAITING DATA Identified Jul 9, 2026

▸ Sequencing Note

This finding is intentionally being held pending Octorara Area School District’s response to OOR Final Determination AP 2026-1329 (production due within 30 days of the June 26, 2026 mailing date). It has not been raised with the District, OOR, or any other body.

▸ What the Record Shows

Correspondence dated December 8, 2023, from then-sitting Board member Brian Fox, sent “from my iPhone” to six recipients: Lisa Yelovich (icloud.com), Lisa Bowman (epix.net), Brian Norris (comcast.net), Matthew Hurley, Jere Zimmerman (sumzim.com — a personal business domain), and Charlie Koennecker (gmail.com), along with Sam Ganow (gmail.com). None of the visible recipient addresses are official @octorara.org accounts. The email’s content concerns materials related to the underlying litigation.

▸ Why It’s Relevant

Pennsylvania RTKL case law generally holds that a public official’s personal email account can fall within an agency’s search obligation when the content pertains to agency business, regardless of which account sent or received it. AP 2026-1329 already establishes — in its Item 2/second-Request analysis and accompanying footnote — that the District bears the burden of proving what does and doesn’t exist, and must provide a sworn affidavit if records aren’t located. This document is a factual basis to ask, in a future request, whether personal accounts used by Board members — including the ones identified here — were included in the scope of any search the District conducted, or whether an affidavit addressing that scope is warranted.

▸ Not Yet Determined / Not Asserted

Whether the District’s search for AP 2026-1329 did or didn’t include personal accounts. Whether any personal-account records are actually responsive to a pending request. Any characterization of intent behind the use of personal email.

▸ Next Step, Sequenced

Wait for Octorara’s production/affidavit in response to AP 2026-1329 (due end of July 2026). If gaps remain regarding personal-account search scope at that point, this document supports a follow-up request or affidavit demand — not before.

▸ Update Log

No updates yet on AP 2026-1329. Entries will be appended here as dated snippets as this finding develops — e.g., “Jul 26, 2026 — Octorara’s production deadline passed; no affidavit received.” When this finding resolves, this page will be redesigned into a full Achievement, and this Update Log will be replaced by the resolution record.
