THREE INTERRELATED RECORDS — HELD PENDING
ADMINISTRATIVE AND JUDICIAL RESOLUTION

▸ How the Three Archives Relate
The three archives document overlapping events involving the same core actors across three separate institutional settings — a school district, and two township police departments. They are not independent records. Each one contains material that contextualizes the others, and certain actors and events appear in all three.
The Octorara archive is the primary administrative record. The East Pikeland archive documents the law enforcement investigation that ran parallel to the criminal proceedings — including the search warrant identifying the domain registrant and the witness intimidation reports involving the same actors. The East Whiteland archive documents a separate law enforcement action — a no-contact advisory issued without a sworn affidavit — and the RTK and court proceedings that followed.
All three intersect through the following actors and events:
Brian P. Fox
Appears in all three archives. Board Director (Octorara), identified domain registrant (East Pikeland search warrant), referenced in East Whiteland RTK-produced records.
Det. / Ofc. Joseph Juisti
Assigned investigator (East Pikeland), referenced in Octorara RTK production, witness to relevant events across both law enforcement archives.
Anthony Falgiatore
Board Director and sworn officer whose testimony and subsequent retaliation thread through all three archives. Subject of witness intimidation reports documented in East Pikeland archive.
Officers Corbo / Paris
East Pikeland officers whose courtroom interactions with prosecution are documented in sworn witness account; whose inter-agency communications appear across both law enforcement archives.
Chester County DA’s Office
Recipient of Fox’s direct contacts (Octorara archive), authorization authority for Juisti’s investigative steps (East Pikeland), and referenced in East Whiteland inter-agency communications.
OOR AP 2026-0167 / 1329
The administrative proceedings that produced the 5,616-page record underlying the Octorara archive — and that are now the primary reason all three archives are being held pending determination.
▸ Archive 1 of 3 — Octorara Area School District
What This Archive Documents
The Octorara Communications archive is the primary source record underlying the Administrative Literacy Achievement Registry. It documents the full administrative sequence from January 2026 through July 15, 2026, including: the January 29, 2026 meeting request and non-response; five RTK submissions and their handling; OOR Appeals AP 2026-0167 and AP 2026-1329; the 5,616-page RTK production and its content; DMCA enforcement actions and the counter-notification identifying @LondonderryX123 as Brian Fox; the May 28, 2026 Cease and Desist sequence and timestamped platform activity; supplemental OOR filings; and the June 25, 2026 public posting and Fox’s 42-minute response. The archive also contains the full text of “What Happened When I Sent The Letter” — a contemporaneous account of May 28, 2026 written and preserved that day.

This archive will be considered for public release after the issuance of the Final Determination in OOR AP 2026-0167 (currently August 28, 2026) and after review of any implications arising from the AP 2026-1329 production. Release timing may be adjusted depending on the content of those determinations and any subsequent proceedings they generate.

▸ Archive 2 of 3 — East Pikeland Township Police Department
What This Archive Documents
The East Pikeland archive documents the law enforcement investigation that ran parallel to Commonwealth v. Miller. It records: the assignment of Detective Joseph Juisti to investigate reported harassment and witness intimidation affecting both Miller and Officer Anthony Falgiatore; the search warrant obtained to identify the registrant of CulturalContrarian.org — which identified Brian Fox — and the failure of that identification to be confirmed to the court, defense counsel, or affected parties; the extended period of investigative stall and conflicting representations regarding Juisti’s status; the November 2024 cessation of communication; RTK requests to the department that produced no records; the April 21, 2026 informational submission to Chief Major; the May 28, 2026 informational notice to the department following the OOR supplemental filing; and the subsequent RTK and OOR appeal process. The archive also contains the Preliminary Statement of Preserved Facts — an unsworn, under-review factual memorialization of the investigative sequence.

▸ Archive 3 of 3 — East Whiteland Township Police Department
What This Archive Documents
The East Whiteland archive documents a no-contact advisory issued by the East Whiteland Township Police Department against Miller without a sworn affidavit from any reporting party and without contemporaneous investigative verification. It records: the RTK request submitted seeking records related to the advisory and its basis; the OOR Final Determination ordering the department to produce records; East Whiteland’s decision to appeal that determination to Chester County Court of Common Pleas (Case #2026-00691-CS); the department’s Entry of Appearance, Answer to New Matter, Certificate of Service, and proposed order filed through counsel at Saxton and Stump; and Miller’s Answer to the Petition filed April 13, 2026. The archive also contains the Preliminary Statement of Preserved Facts documenting the no-contact advisory sequence and the inter-agency communications surrounding it.
Active Proceedings — Chester County Court of Common Pleas
| DATE | FILING / EVENT | PARTY |
| Early 2026 | OOR Final Determination — production ordered | OOR |
| Feb/Mar 2026 | Agency Petition for Review filed · Case #2026-00691-CS | EWPD |
| 04/13/2026 | Answer to Petition filed by Requester | Miller |
| 05/04/2026 | Entry of Appearance, Answer to New Matter, Certificate of Service filed by EWPD counsel | EWPD |
| 05/04/2026 | Proposed Order transmitted (not yet entered by Court) | EWPD |
| Jul 2026 | Matter under judicial consideration · No ruling issued as of this index date | Court |
▸ Public Availability Trigger
This archive will be considered for public release after the Chester County Court of Common Pleas issues a ruling in Case #2026-00691-CS and after review of any further proceedings that ruling may generate. Because this matter is in active litigation before a court — not an administrative body — the timing of release is less predictable than the OOR-based archives above.
